It happens more than you think. A family goes to sell their loved one's property only to discover there are unpaid liens on the home.๐ฑ This can be anything from first or second mortgages, property taxes due to the county, unpaid income taxes, unpaid utility bills, mechanics' liens (someone did work on the house and hasn't been paid), or even a lien that was incorrectly placed on your loved one for a debt they do not owe. In most of these cases, the title company must reach out to the lien-holder to find out what the payoff is and then make sure this amount is paid by the seller(s) at closing. Sometimes the sale price needs to be increased - which happened to one of my clients recently - to ensure the proceeds from the sale cover the liens. If it is an errorโ and the debt is not๐ซ your loved one's, it's a little more work for the title company because they will need proof that the lien is an error. Don't wait until you're ready to sell to find out what liens may be on your property. You can have a title exam run at any time for about $350. Contact your favorite title company.
